This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, mandating the publication of rules, regulations, privacy policies, and terms of use for access or usage of the services provided by the eFANTOM partnership firm.

eFANTOM, operating under the brand name "Flits," is a partnership firm registered in India, with its principal office located at #307, North Plaza, Visat-Gandhinagar Highway, Motera, Ahmedabad, Gujarat – 380005. References to “Flits,” “Company,” “We,” “Us,” or “Our” shall be deemed to include its affiliates, successors, and permitted assigns. The term “You,” “Your,” or “User” refers to any person accessing or using the Website.

The domain name getflits.com ("Website") is owned and operated by Flits. By accessing, browsing, or using the Website, You acknowledge that You have read, understood, and agree to be bound by these Terms of Use ("Terms"). If You do not agree to these Terms, please refrain from using the Website.

1. Acceptance and Applicability

Your use of the Website indicates Your acceptance of these Terms, which shall be legally binding and enforceable, equivalent to a written agreement executed by You.

2. Grant of Rights

Subject to compliance with these Terms and all applicable laws, Flits grants You a limited, non-transferable, non-exclusive, and revocable right to access and use the Website for internal business purposes only.

3. Eligibility

By using the Website, You confirm that You are of the legal age of majority under the laws applicable in Your country/state of residence. If You are using the Website on behalf of an entity, You represent that You are authorized to bind the entity to these Terms.

4. User Registration and Shopify Data Access

When using Flits, We may access necessary data from Shopify’s API as per Shopify's guidelines. Your data will be utilized only as needed for selected features, in compliance with Shopify’s data usage policies.

5. Subscription and Payment Terms

Following the free trial period, continued use of services requires a valid subscription. Subscription plans and usage-based charges are displayed on the Website and the Shopify billing interface. Payments are processed via Shopify and governed by Shopify’s App Store Terms.

You may cancel Your subscription through the Shopify App or by uninstalling Flits. Full refunds are provided for cancellations within the same billing month.

6. Prohibited Use

You agree not to misuse the Website/App and its data, including but not limited to:

• Engaging in illegal or fraudulent activity
• Transmitting harmful or malicious software
• Sending unauthorized commercial messages
• Infringing upon intellectual property rights
• Interfering with system functionality or security
• Reverse engineering or unauthorized access
• Using scraping tools without prior consent

Any such conduct will result in immediate termination of access and potential legal action.

7. Intellectual Property

All content, including trademarks, logos, and slogans on the Website, are proprietary to Flits. You may not reproduce, distribute, or exploit any part of the Website without written consent.

8. Confidentiality

We will maintain the confidentiality of any sensitive information shared with us in accordance with industry-standard security practices. However, Flits shall not be held liable for unintentional breaches.

10. Service Level Commitment

We aim to maintain 99% uptime of our services. In the rare case of extended downtime, at our sole discretion, we may offer monetary credits applicable to Your next billing cycle.

12. Limitation of Liability

We adhere strictly to Shopify’s regional and legal usage policies. Services may be unavailable in jurisdictions restricted by Shopify or applicable law.

These Terms shall remain in effect unless terminated by either party. Flits reserves the right to suspend or terminate Your access without prior notice if You are found to be in violation of these Terms.

17. User Submissions

You are solely responsible for any content submitted through the Website/App. Flits disclaims any liability for content posted by Users.

19. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

20. Entire Agreement

These Terms constitute the full agreement between You and Flits, superseding all prior agreements or communications.

22. Jurisdiction

These Terms shall be governed by the laws of India. All disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat (India).
